      公共图书馆法人治理结构作为当前和今后一段时期我国公共文化服务领域的重点工作,在中央层面将试点工作向纵深推进的过程中,形成了参考经验,奠定了政策基础,发挥了试点溢出效应,带动了全国各级各类公共图书馆的试点探索。本文通过对7个国家级公共图书馆法人治理结构试点单位的调研,发现我国公共图书馆法人治理结构在试点过程中仍面临区域发展不平衡、突破创新有限、社会参与力度不够、理事会决策支撑力度不够等问题。建议要明确各利益相关方边界,制定一系列相配套衔接的规章制度,制定各地“图书馆事业发展基金会”制度及畅通的收支渠道,改革创新人事制度并因时因地不断改革完善等,逐步建立起以公益目标为导向、决策专业科学、激励监管制度健全的现代治理结构,全面提升我国公共图书馆的治理水平和服务效能。表6。参考文献11。

    The governance level of public libraries and the efficiency of public cultural services have been significantly improved in China over the last decade. Especially thePublic Cultural Service Guarantee Law of the People's Republic of China, theImplementation Plan of Deepening the reform of the corporate governance structure of public cultural institutions and the Public Library Law of the People's Republic of Chinastabilized the corporate governance structure of public libraries and brought it under the rule of law. With these policies and regulations, the corporate governance structure for public libraries has been put forward. During the process of the reform, seven pilots have served as the national pilots, which represent the eastern, central, and western areas of China and actively explored different administrative levels and different categories. These pilots have provided reference experiences, a policy base, and good models for boosting exploration of the new corporate governance structure in all kinds of public libraries across the country. However, the proposed corporate governance structure, as a legal system, is still restricted by traditional ideas and pre existing mechanisms and suffers from issues such as unbalanced regional development, limited breakthrough innovations, insufficient government support for social forces, and insufficient support for the decision making power of the boards. Therefore, based on the requirements defined in the central laws and regulations and the Central Reform Leading Group, further development of the corporate governance structure of public libraries in China should focus on the following aims: strengthening the administrative organizational leadership and clarifying the responsibilities scope for each stakeholder; authorizing more rights for the public library board; establishing a joint conference system for coordinating all the stakeholders; extending the independent legal status for public libraries; promoting the co construction and sharing of resources throughout the whole society synergistically; clarifying the responsibilities of the decision maker, the management, the supervisor, and the party organization by making a series of matching rules and regulations; assisting in making more scientific and professional decisions by establishing a literature resource construction committee, a finance project committee, a performance evaluation committee, a supervision and administration committee, a temporary executive committee, and other professional committees; creating an “Accountability Checklist” by introducing a responsibility tracing system into decision making that emphasizes holistic social participation; adhering to the financial centralized management system between income and expenses by establishing and implementing rules for the “Librarianship Foundation” to guarantee the smooth flow of funds; reforming and innovating the personnel system by creating and perfecting librarians joint appointment, cultivating and training trustees of the board. Meanwhile, the contemporaneity and the regional characteristics of libraries should be reflected. Accordingly, China's nationwide modern public library governance structure should aim to establish and perfect the joint conference system, the board negotiation system, the annual report system, the information publicity system, the responsibility tracing system for decision making, the librarians joint appointment system, the integration system of the main members between the board and the party organization, the audit supervision system, and the performance evaluation system about the corporate governance structure to follow different domestic levels and types of public libraries. With those elements in place, modern public library governance structure would be public welfare oriented, professional, and based on scientific decisions and a sound incentive based supervisory system gradually. 6 tabs. 11 refs.
